Definitions and terms

BALDO is a registered trademark of BALDO S.R.L. with its headquarters at Str. Fostului C.A.P., f.n., com. Totoi, Alba County, registered at the Trade Register under no. J01/282/2002, unique tax registration number: RO 14755042, tel: 004 / 0258.842161; fax: 004 / 0258.842515, with the official website: www.baldoitaly.it, through which intra-Community trade is made;

 

Seller: BALDO SRL, Romanian legal entity with its headquarters at Str. Fostului C.A.P., f.n., Totoi, Alba County, J01 / 282/2002, CIF: RO 14755042;

Buyer: can be any individual who is over the age of 16 and who performs an order;

Client: an individual or a company that orders and / or purchases products through the virtual store www.baldoitaly.it;

Offer: the available products that are being offered for sale in a given period of time and at a certain unit price;

Product: the goods / objects offered for sale;

Price: the price at which the products are being sold to the buyer; the displayed price is the unit price for each product offered for sale and it contains VAT;

Order: the purchase order by which the customer requests to buy the selected products according to the features presented on the website, at the price that is being displayed and by using the chosen payment method, according to the delivery terms displayed on the website; the order containes all the items requested by the seller, so that he can issue invoices, make the delivery and/or contact the client if needed;

User: any person registered on the website, that by making an Account, has given its consent to the website-specific clauses written in the General Terms and Conditions section.

Content: the text, the digital photos, images, technical data, prices and any other information found on www.baldoitaly.it

Goods and Services: any product or service listed on the website, including the goods mentioned in the Order, that are about to be provided to the Buyer by the Seller, according to the concluded Contract.

Contract: represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.

Compliance Guarantee: is the act that certifies that the product bought by the client is the same as the one specified in the sale-purchase contract.

 

Newsletter: an electronic document being sent periodically, containing information about various products and/or discount media, campaigns or any other information about the seller's actions / activities in a given period of time.

 

Buying products on the webside: www.baldoitaly.it involves accepting the terms and conditions detailed in the following paragraphs.

The terms and conditions written in this section govern the contractual relationships between the seller and the customer and / or member. Contract relationships originate when the customer places an order on the website www.baldoitaly.it, each order generating a distinct contractual relationship from the previous and / or future ones.

 

Once an order is placed, the customer agrees with the sale terms, such as the terms and conditions displayed on the website: www.baldoitaly.it. The contractual relations are subject to the legal norms from Romania.

Placing an Order

- first one must select the product, add it to the cart and continue with the navigation on the website to the ,,Completing the Order” page, unless the customer wants to add another product to the cart, case in which he must return to the Products page;

- the customer can then continue to complete the order, for which he must enter the name, surname, e-mail address, telephone number, so as the courier is able to contact him when necessary, the delivery / billing data and the payment method;

- by accepting the Terms and Conditions on the website, the Client enters into a cancellable contract with Baldo SRL, completing the order;

 

Order confirmation

Within maximum 3 working days from the moment the order was placed, the seller will send an order confirmation e-mail to the customer, containing a summary of the order and details regarding the delivery.

 

Also, before confirming the order, the seller can contact the customer by phone and / or by e-mail in order to verify the order and/or the provided data.

 

Responsability

In case of failure to deliver an order or inappropriate delivery, the value that Baldo srl will pay is equal to the value of the ordered products, if the payment has been already made by the customer. If the customer was the one that payed the transport, Baldo will also refund these costs to the customer.

 

Payment of the products

The payment of the products can be made with cash at the delivery or online by using the PayPal services or the Credit Card. Prepaid Cards or other payment methods are not allowed.

Baldo can absolutely secure the online payment by using the assistance of the PayPal supplier.

 

Since Baldo srl does intracomunitary sales, all the prices listed on the online store's catalog will be shown in euro. All displayed prices include VAT and do not include delivery costs. The products are being sold with the prices that were listed when making the order.

 

The delivery costs are indicated during the order issuing process, within the ,,Store” section. Shipping costs may be changed: however, these changes will have no value in addition to the orders issued before publishing the changes on the website.

 

Delivery

The ordered product will be delivered to the buyer within 5 working days (if the product is available) or otherwise within thirty days from the moment the order was received.

 

If the delivery is not possible within 30 (thirty) days, the client can cancel the order. If all the payments have been made, they will be refunded by Baldo srl within 30 (thirty) days.

 

Delivery costs

The order is being sent at the expense of the buyer at a calculated charge, depending on the destination, with the average price being 10 euro for each delivery.

 

Viewing the contract

General terms and conditions regarding the relationship between the seller and the buyer are available on the website and can be viewed at any time in the "Terms and Conditions" section.

 

The right to withdraw from the contract

The buyer has the right to withdraw from contract within a maximum of 14 calendar days, starting from the day when the buyer received the package with products.

The standard withdrawal form can be completed accorgind to Annex 1 and sent electronically to the address e-mail This email address is being protected from spambots. You need JavaScript enabled to view it.. The seller will then send an e-mail as a confirmation of receiving the withdrawal request.

 

Returning a product

The request to annul the contract will only produce effect if the products will be returned to the seller before the 14 day expiration date, starting from the moment the goods were received by the buyer, and only if the products present no traces of usage and are not damaged from the client's fault.

 

The products returned as a result of exercising the right to withdraw from the contract must be accompanied by the purchaser's data, the invoice, the telephone number, the e-mail address and the bank account where the refund money will be transferred in case the client paid with a Credit Card.

 

In the event of annuling the contract, the seller will refund the value of the product for which the buyer has withdrawn from the contract, including the delivery costs, but except the additional costs resulting from the buyer's choice to have the product delivered using a different method than the cheapest standard delivery method offered by the seller. The action will have to take place within the 14 calendar days starting from the day on which the product for which it has withdrawn from this contract is in the possession of the seller.

 

A product's refund will be made using the same payment method as the one used for the original transaction, unless the buyer expresses the agreement for another refund method.

The direct cost of returning the goods belongs to the buyer. The buyer is only responsible for diminishing the value of products resulting from manipulations other than those necessary to determine the nature, quality and performance of the products.

 

Shoe and Leather Maintenance Tips:

The following instructions are for shoe products, made out of wood and leather soles.

- Vary the shoes, do not wear the same pair of shoes every day.

- To increase the use length, we advise you to alternately wear several items (at least 2) of footwear in a period of time and to maintain them regularly.

- After each wear, let the shoes dry. Do not forget that your feet are sweating too.

- In order to maintain the shoe shape in time, the product can be filled with paper or, placed on a shoe holder. Do not force drying on a radiator, fire, hair dryer or any other direct heat source.

- Articles must not be stored near any heat sources or in humid environments, it must be avoided the action of petroleum products and/or organic solvents. After each wearing, we recommend that you clean the shoes properly and apply the measures to maintain the initial shape.

- Use only products that are designed specifically for footwear made of natural leather.

- Shoe damage caused by driving a car is not considered a manufacturing defect.

- Footwear and leather goods should be protected from direct contact with organic solvents (petrol, alcohol, acetone, etc.).

 

 

Materials used in Baldo footwear's manifacture:

The Baldo trademarked shoes are made up of first quality materials only, with beech wood soles and natural leather sides. Depending on the model, one or two springs are inserted between the two wooden soles. These springs have the role of improving foot's blood circulation, cushioning the impact with the ground while walking.

 

 

Natural leather

The leather used in making the Baldo footwear is of natural origin. It allows the foot's skin to breathe, has very good absorption qualities and it adapts to the shape of the foot. Depending on the model, some pairs of footwear contain an extra layer made of natural lining.

 

Baldo shoes are not waterproof. We recommend that you take into consideration the action of external factors (climatic factors), but also internal (sweat).

 

Baldo's footwear made out of leather and / or lining is mostly recommended for indoor wear, but some models are also intended for outdoor wear. It is recommended, however, that the shoes in question should not be worn on wet, rainy or non-smooth surfaces such as gravel, sand, etc., as it will accelerate the attrition process of the shoe.

ATTENTION! The trader can not be held responsible for any incidents resulting from the non-appliance of the above mentioned instructions or the inconveniences caused by wearing the inappropriate shoe size or model.

 

Guarantee:

 

The liability of the seller in regards to the legal guarantee of conformity, according to the provisions of art. 9-14 of the romanian Law 449/2003, is committed if the lack of conformity occurs within 2 years, starting from the day the product was delivered. Once the term stipulated in art. 16 has expired, consumers may claim the repairment or replacement of the products that can not be used for the purpose for which they were made, as a result of hidden defects occurred within the average use period, under the law.

The consumer must inform the seller of the lack of conformity, within two months starting from the date he has found it.

This warranty is in accordance with the consumer rights offered by the romanian legislation in force (Law 449/2003, OG 21/1992).

Under the romanian Law 449/2003, art. 11, in the case of lack of conformity, S.C. BALDO.S.R.L. firstly provides the repair of the product as a warranty mean and, secondly, the replacement of the product when the product cannot be brought into conformity by being repaired, depending on the deficiencies found and, lastly, the value of the product if the product cannot be brought into conformity by repair or exchange.

 

The settling complaints deadline is no longer than 30 calendar days starting from the day the claim was registered by the seller.

 

In order for the warranty to be provided, it is necessary to follow the above mentioned shoe care tips. One must anticipate and eliminate the factors that may adversely affect the footwear's length of use, as listed in the Shoe and Leather Maintenance Tips Section, previously presented.

The customer's personal data is being processed by the seller only with the express agreement of the customer.

 

Customer's personal data provision is voluntary but necessary in order to create an Account and to conclude the Sales Contract.

 

Depending on the use of specific functions, the client has the right to file a complaint at the competent authority in regards to the protection of personal data, he has the right to oppose, the right to access his or her personal data, to request rectification, deletion, limitation of processing and data transfer.

Final provisions:

In the cases that are not governed by this Regulation, the applicable general provisions of Romanian law shall apply, namely: the Civil Code; Law 34/2014 on consumer rights, Law 356/2002 on electronic commerce, HG 1308/2002 on the approval of methodological norms for the application of the Law 356/2002 on electronic commerce, Law 193/2000 on unfair terms in contracts concluded between professionals and consumers, Law 449/2003 on the sale of products and associated guarantees, Law 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector and of Ordinance no. 130/2000 on the protection of consumers in the conclusion and execution of distance contracts with subsequent amendments.

 

Litigation

The present Agreement is subject to Romanian law. Any disputes arising between BALDO SRL and Clients / Buyers will be settled amicably or, if this is not possible, the litigations will be settled by the competent Romanian courts from Alba County.
